Andrés Chomczyk Penedo
Andrés Chomczyk Penedo is a postdoctoral researcher at the Faculty of Law (ICADE) of Comillas Pontifical University. Previously, he was a postdoctoral researcher at the Institute of Law and Technology (IDT) of the Universitat Autònoma de Barcelona (UAB), where he held a Juan de la Cierva postdoctoral fellowship from the Spanish Ministry of Science, Innovation and Universities. He has also taken part in EU-funded projects such as INDUX-R. He obtained a PhD in Law from Vrije Universiteit Brussel, where he was a predoctoral researcher in the Law, Science, Technology and Society (LSTS) research group. He is currently still associated with this research group as an affiliated researcher. During his time as a doctoral researcher at LSTS, he contributed extensively to other EU-funded projects, such as LeADS, PANELFIT and SOCIO-BEE. In addition, he was also actively involved in the activities of the Brussels Privacy Hub (BPH), where he remains associated as a senior fellow in digital finance. His doctoral thesis was carried out in the context of the PROTECT MSCA ITN project, where he was a Marie Skłodowska-Curie Fellow from 2019 to 2023, under the supervision of Professors Dr. Paul De Hert and Dr. Paul Quinn. His doctoral research focused on innovative ways to empower individuals to make meaningful and informed decisions about their data in the context of the EU’s 2020 Data Strategy. Drawing on concepts from EU financial services regulation, the dissertation explored the possible existence of a duty of assistance owed by data controllers to data subjects, to help them navigate data-related choices and enhance current transparency practices. Previously, he obtained a Law degree from Universidad Austral (Argentina) and completed a Master’s in Data Protection at the Universidade de Santiago de Compostela (Spain). He has worked as a consultant for international organizations such as the Inter-American Development Bank and the Inter-American Institute of Human Rights. His research activities and interests focus on the intersection between data protection and financial services, with several publications addressing both EU and Latin American regulation. In particular, his work focuses on the creation of spaces for the free flow of financial data, such as open banking and open finance, at the European and international levels.
